Terms of Service

2. Eligibility and Accounts

You must be at least 13 years old to use BetaFlow. If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian.

You are responsible for the accuracy of account information you provide and for maintaining the confidentiality of your account credentials. You are responsible for activity that occurs under your account.

3. What BetaFlow Provides

BetaFlow helps indoor climbers log climbing sessions, track grades and attempts, review recaps, build progress history, set goals and streaks, and request AI-powered grade help or coaching summaries.

We may change, add, remove, limit, or discontinue features at any time, including free features, AI limits, integrations, or BetaFlow Coach features.

5. AI Features

BetaFlow may provide AI route grade estimates, session analysis, weakness and pattern detection, weekly reports, and coaching prompts. AI outputs can be incomplete, inaccurate, or unsuitable for your circumstances.

AI grade estimates are not official grades. AI coaching prompts are suggestions only. You should not rely on BetaFlow to make decisions that could affect your health, safety, or injury risk.

6. Your Content

You retain ownership of the climbing logs, route photos, notes, goals, messages, and other content you submit to BetaFlow ("User Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and create technical derivatives of User Content only as needed to operate, secure, support, and improve the Services, including AI features you request.

You agree not to upload content that is unlawful, harmful, infringing, misleading, abusive, or contains sensitive personal information about another person without permission.

8. Integrations and Third-Party Services

BetaFlow may integrate with Apple Health, HealthKit, Strava, app stores, analytics providers, AI providers, and other third-party services. Your use of third-party services is governed by their terms and privacy policies.

We are not responsible for third-party services, data practices, availability, outages, content, or decisions made by those providers.

9. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, fraudulent, abusive, or misleading purposes.
• Interfere with, disrupt, overload, scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Services.
• Upload malicious code, spam, infringing content, or content that violates another person's rights.
• Misrepresent grades, sessions, purchases, rewards, or account activity in a way that abuses the Services.
• Use AI outputs to create unsafe training, medical, or safety instructions for yourself or others.

We may suspend or terminate access if we believe you violated these Terms or created risk for BetaFlow, users, or third parties.

10. BetaFlow Intellectual Property

The Services, including software, design, text, graphics, logos, trademarks, trade dress, and other materials, are owned by GTM Bot Inc. or its licensors and are protected by intellectual property laws.

These Terms do not grant you ownership of BetaFlow or any BetaFlow intellectual property. You may not copy, modify, distribute, sell, or create derivative works from the Services except as allowed by law or with our written permission.

11. Privacy

Our Privacy Policy explains how we collect, use, and share information when you use BetaFlow. By using the Services, you acknowledge the Privacy Policy.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not guarantee uninterrupted service, error-free operation, data availability, AI accuracy, grade accuracy, training outcomes, performance improvement, or injury prevention.

To the fullest extent permitted by law, GTM Bot Inc. disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, GTM Bot Inc. and its affiliates, officers, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to your use of the Services.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid to BetaFlow for the Services in the 12 months before the claim or 100 U.S. dollars.

14. Indemnification

You agree to defend, indemnify, and hold harmless GTM Bot Inc. and its affiliates, officers, employees, contractors, and partners from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Services, your User Content, your violation of these Terms, or your violation of another person's rights.

15. Changes, Suspension, and Termination

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Continued use of the Services after an update means you accept the updated Terms.

We may modify, suspend, or terminate the Services or your access to them at any time, including if we believe you violated these Terms or if continuing service creates legal, security, operational, or business risk.

16. Governing Law

These Terms are governed by the laws of the State of Nebraska, United States, without regard to conflict of law principles.

Any disputes will be resolved in the state or federal courts located in Douglas County, Nebraska, unless applicable law requires otherwise.
